1.  INTRODUCTION

Welcometo Sunbet Namibia, we are committed to ensuring that your experience with us isenjoyable, secure, and transparent. As an online gaming and betting platform,our operations are governed by various laws and regulations. These Terms andConditions (“the Rules”) clearly explain those requirements and outline how ourservices may be used.

Thank you for taking the time to review theSunbet Namibia Rules. They are designed to help you understand what you can andcannot do on our platform, how we handle and protect your personal information,and how we operate and manage the Site. We have aimed to keep the legallanguage to a minimum while still ensuring clarity and compliance.

2. FUNDAMENTALS

The Rules constitute a binding agreement between you and SunbetNamibia and by clicking your acceptance of the Rules when creating an account,using the website or accepting any bonus or prize, you confirm that you haveread, understood, and agreed to be bound by these Rules and any futureamendments. As laws and operational requirements evolve, we may update theseRules from time to time. If any changes are deemed material, we will notify youin advance and request your consent before such amendments take effect.

 

3. DEFINITIONS

You will see the following terms used throughout these Rules:

“Bonus” refers to all promotional offers that provide a tangible reward,including but not limited to welcome offers, reload bonuses, and depositbonuses.

“Games” refers to all gaming and betting products offered on our Site,including Sports Betting and any other games or services made available on anyplatform (desktop, mobile, or app). We may add or remove Games from the Site atany time.

“Rules” means these terms, conditions, and policies that you agree to whenusing the Site.

“Site” refers to www.sunbet.com.na , including(where applicable) any mobile version, mobile application, or any relatedsubdomains operated by Sunbet Namibia.

“We”, “us”, “our” refers to Sunbet Namibia, aprivate company duly incorporated in the Republic of Namibia and licensed as anonline bookmaker.

“You” refers to the individual using the Site and/ or any SunbetNamibia services. “Your” has its ordinary meaning in relation to you.

“Your Account” refers to your registered playerbetting account registered with Sunbet Namibia on the Site, created inaccordance with our registration, verification, and Know-Your-Customer (KYC)requirements under the Namibian law.

4. ELIGIBILITY

Toregister an account with Sunbet Namibia, you must:

  1. be at least 18 years of age, as required by the Namibian law;
  2. be a natural person, acting in your personal capacity;
  3. participate solely for your own benefit; and
  4. be legally permitted to engage in gambling.

5. ACCOUNT REGISTRATION AND VERIFICATION

  1. To access and use the services provided by Sunbet Namibia, you must register a player account. Sunbet Namibia reserves the right, at its sole discretion, to reject any registration for a new account or to cancel an existing account without prior communication to you. Sunbet Namibia may request all required documentation in terms of the Financial Intelligence Act, 13 of 2012 (“FIA”) at the time of registration or at any point during the customer relationship with Sunbet Namibia.
  2. Without limiting the generality of the above, Sunbet Namibia reserves the right, at its ole discretion and without prior notice, to suspend or permanently deactivate your account and/ or take legal action against you where it is proven, or reasonably suspected that:
    1. any provision of these Terms and Conditions has been breached;
    2. you have provided false, inaccurate, or misleading information regarding your account or any deposit made;
    3. you are suspected of using a fraudulent bank account and/ or depositing with a lost or stolen card;
    4. you have registered or operated more than one account;
    5. you permitted a third party to access or use their account for the purpose of placing bets;
    6. you are using Sunbet Namibia’s services fraudulently or in the commission of any unlawful activity;
    7. you have failed to provide proof of source of funds for any deposit or series of transactions when requested;
    8. FIA requirements have not been met;
    9. you have abused any bonus, promotion, or incentive;
    10. transactions in the account
    11. Any provision of these Terms and Conditions have been violated;
    12. The player has provided false or misleading information regarding the players account, or any deposits made by the player;
    13. The player is using a fraudulent bank account and/ or depositing with a lost or stolen card;
    14. The player has operated more than one account;
    15. The player has permitted a third party to access their account for the purpose of placing bets;
    16. The player is using Sunbet Namibia’s services in a fraudulent manner or in the commission of fraud;
    17. The player has failed to provide proof of the source of funds for any deposit or series of transactions upon request;
    18. FIA requirements have not been met by the player;
    19. The player has attempted to abuse any bonus or promotion;
    20. Any player transactions are deemed by Sunbet Namibia to be suspicious or questionable; and
    21. It is required by law.

 

6. BETTING ACTIVITY

  1. Sunbet Namibia will cancel and void any, and all bets, and return all funds deposited into an account that Sunbet Namibia or the relevant authorities determine to have been registered by or on behalf of an individual under the age of 18.
  2. Sunbet Namibia exclusively reserves the right, at its sole discretion, to limit, reject, and/or cancel any bets that have been accepted and confirmed by Sunbet Namibia, which are deemed to have been fraudulently, accidentally, or erroneously placed. In an event that Sunbet Namibia suspects any fraudulent activity related to any account or bet, Sunbet Namibia reserves the right to suspend the account until such time that it is satisfied that all transactions are lawful. Any bets that are fraudulently placed will be voided, and Sunbet Namibia will report such fraudulent activities to the appropriate authorities.
  3. Bets will only be valid when placed in accordance with Sunbet Namibia’s betting rules, policies, and terms and conditions.
  4. Sunbet Namibia reserves the right to modify or amend its betting rules, policies, terms, and conditions at its sole discretion and without prior notice to the player.
  5. It is the player’s responsibility to ensure that their bet is accurate before placing the bet. Once a bet has been placed and accepted (as indicated by on-screen acknowledgment), the bet cannot be canceled or modified by the player.
  6. Sunbet Namibia reserves the right, at its sole discretion, to select the available betting options, including but not limited to, events, markets, all betting options, odds, and the acceptance or refusal of any bets. Sunbet Namibia may add or remove betting offerings on any sports, events, markets, and betting options at its discretion, and reserves the right to make changes without notice to the player.
  7. All bets and markets are subject to minimum and maximum stakes. It is the player’s responsibility to be aware of any stake limits that apply. The maximum stake limits apply per Player, per bet, and per day. The player warrants that they will not intentionally exceed the stake limits. Any bets placed in an attempt to circumvent these limits, including bets placed on other player accounts or multiple bets placed on a single account to exceed the stake limit, will be voided at Sunbet Namibia’s discretion.
  8. Players agree that, in the unlikely event of a discrepancy between the result shown on their screen and the result displayed on the game server, the result from the game server will prevail.
  9. Without limitation, Sunbet Namibia may, at its discretion, decide on the validity of a bet or a player’s entitlement to winnings, or void a bet under the following circumstances, where:
    1. Bets were placed after the relevant deadline or after the start of the relevant draw;
    2. Bets were mistakenly accepted after the relevant deadline or if the relevant drawing had already begun or concluded;
    3. Sunbet Namibia discovers an error related to a bet or draw and is unable to contact the player to correct the error or confirm the bet before the deadline;
    4. The bet was placed by a player who has provided false or misleading information related to their player account or in connection with the website or services;
    5. The bet was placed by a player involved in fraudulent, dishonest, or illegal activities related to the bet or the operation of the player account;
    6. The player account has been accessed or used by someone other than the player themselves;
    7. The bet was placed on behalf of a player who is under 18 years of age, or is or was a director, officer, or employee (or their spouse or dependent) of Sunbet Namiba or any of its affiliated companies;
    8. The player maintains more than one Player account;
    9. The player is a self-excluded individual;
    10. The player is prohibited by law, regulation, or other legal frameworks from placing a bet or entering into a betting transaction;
    11. Any fraud, manipulation, system or data manipulation, technical or human error, or undue influence is detected in relation to a draw;
    12. A website or game malfunction occurs;
    13. A draw or round is declared invalid by the organizer or co-organizer, or by an independent auditor;
    14. The player has used a stolen, lost, or unauthorized card to deposit into their Sunbet Namibia account.

7. PROHIBITED ACTIVITY

  1. For the purposes of these Terms and Conditions, “prohibited activities" shall include, but are not limited to, any actual or attempted act by the player that Sunbet Namibia, in its sole discretion, deems:
    1. To constitute or potentially constitute a criminal offense;
    2. To give rise to civil or criminal liability with the intent to defraud Sunbet Namibia and/or circumvent any legal restrictions;
    3. To violate any applicable law;
    4. To involve manipulation of the Sunbet Namibia systems and/or website;
    5. To involve unethical and/or unfair betting practices, including, but not limited to, opposite betting patterns or techniques; and/or
    6. To involve any other actions made by the Player in bad faith.
  2. The acts or attempted acts described above shall be considered prohibited activities, regardless of whether they result in any actual damage or harm to Sunbet Namibia.
  3. Sunbet Namibia reserves the right to take any, and all legal action against players who engage in any of the prohibited activities, as well as against any person who may have benefited from such activities.

8. MONITORING OF ACCOUNT ACTIVITY

By using our services, you agree that Sunbet Namibia reserves theright to monitor all betting account activity for irregular, unusual,suspicious, or unlawful behavior as part of our ongoing account management. Inthe event that such activity is detected, Sunbet Namibia may take immediateaction, including but not limited to the deactivation of a player's bettingaccount. This monitoring is carried out in compliance with our legalobligations and is essential for maintaining the integrity of our platform, aswell as ensuring a fair and secure betting environment for all players.

9. BANKING

  1. Deposits:
    1. Players must register with Sunbet Namibia before making a deposit into their accounts.
    2. Deposits into the betting account may be made via debit/credit card, EFT, Direct Deposits, or any other method available from time to time on the deposits page. Payments must be made from a debit/credit card or bank account in the player's name. However, all transactions are deemed to have been authorized by the lawful cardholder. In the event that a player makes a deposit using a bank account or debit/credit card not in their name, Sunbet Namibia reserves the right, but is not obligated, to request all necessary information to confirm that the player has the requisite authority to make deposits using such debit/credit card and/or bank account.
    3. For EFT deposits, Sunbet Namibia will require either a bank-generated proof of payment or email confirmation of the payment showing the account name and player's name before processing a deposit into the player's account, unless the deposit is automatically credited.
    4. Sunbet Namibia will not be held liable for any payment that cannot be traced due to an incorrect reference input by the player. If any amount is credited to another profile due to an incorrect reference, Sunbet Namibia will not be liable if such funds are used by another player to place bets.
    5. Money deposited into a Sunbet Namibia account is held by Sunbet Namibia on the client’s behalf until it is used to place a bet.
    6. Deposited amounts must be played through at least once before a withdrawal can be requested. If a deposit has not been played through at least once and a withdrawal is requested, Sunbet Namibia reserves the right to apply a fee equivalent to the fee incurred by Sunbet Namibia for processing the deposit to the deposited amount or any portion thereof that has not been played through, prior to processing the withdrawal.
    7. All cancelled withdrawals will be returned to the player’s Sunbet Namibia account.
    8. Sunbet Namibia reserves the right to charge applicable processing or transaction fees, including, but not limited to, any fees charged by third-party merchants or processors.
    9. Sunbet Namibia reserves the right to charge any fees incurred if a player makes a deposit and then processes a withdrawal with little or no betting activity placed in comparison to the deposit amount. The player's account may be suspended, and any fees incurred by Sunbet Namibia for the deposit and withdrawal will be charged to the player's account.
    10. No interest shall accrue on any amount held by Sunbet Namibia in a player's betting account.
    11. Any funds erroneously deposited into a player’s account or Sunbet Namibia’s bank account will be reversed after consideration of the circumstances surrounding the erroneous deposit. All bank charges or fees incurred to process the deposit and reversal will be borne by the player or person who erroneously made the deposit. The erroneous deposit will only be reversed to the account from which it was received or to an account nominated by the erroneous depositor, provided it can be proven that the erroneous depositor owns the nominated account. Sunbet Namibia reserves the right to request any documentation it deems necessary for the reversal of any erroneous deposit.
  2. Withdrawals:
    1. Withdrawals from a betting account will only be made to a bank account in the name of the player. Sunbet Namibia will not be liable under any circumstances where any banking details have been manipulated and/or changed, with or without the authorization and/or involvement of the player.
    2. Sunbet Namibia reserves the right to decline withdrawal requests where the Customer has requested payment to be made into a bank account in the name of anyone other than the player.
    3. Sunbet Namibia will only pay winnings to Namibian bank accounts in Namibian Dollar.
    4. Sunbet Namibia relies solely on third-party banking systems to effect withdrawals via EFT. Consequently, Sunbet Namibia accepts no liability should the service be unavailable and/or for withdrawals being delayed for any reason whatsoever.
    5. Sunbet Namibia will not be held liable if incorrect information is provided by a player regarding their bank account number, cell phone number, or any other relevant details.
    6. Money held in a Sunbet Namibia account may be refunded upon request, subject to 24 to 72 hours' notice to allow Sunbet Namibia to verify that all Terms and Conditions have been complied with.
    7. Sunbet Namibia reserves the right to withhold a withdrawal of funds where there is suspicion that the account is not being used for a legitimate purpose or where suspicious/irregular activity, including but not limited to money laundering or fraud, is detected. An inspection will be conducted on the account, and any fees incurred in processing transactions will be charged to the player's account.

      Chargebacks:

    8. In the event that Sunbet Namibia incurs any chargebacks, payment reversals, or other charges related to a player’s account, Sunbet Namibia reserves the right to recover such amounts directly from the player.
    9. All players warrant, represent, agree, and undertake that no chargebacks, payment reversals, or other charges will be made in connection with their account without prior written approval from Sunbet Botswana. Should any chargeback, reversal, or other charge occur, players agree to indemnify and hold Sunbet Namibia harmless against any such amounts, costs, damages, claims, or other expenses related to chargebacks, reversals, or other charges or in connection with Sunbet Namibia’s efforts to recover such amounts from the player.

10. DORMANT ACCOUNTS

  1. A dormant account refers to an account that has had no transactions for a period of 90 days. An account will be considered dormant if there has been no deposit, withdrawal, or placement of a bet for 90 consecutive days. After 90 days of inactivity, any funds in the dormant account will be deemed invalid.
  2. In the event of a player's death, any remaining funds in the player’s account will only be paid to the Estate's bank account upon the provision of appropriate proof. Sunbet Namibia reserves the right to request any documentation it deems necessary regarding the Estate's bank account and the Executor or Administrator of the Estate.

11. SUSPENDED, EXCLUDED OR DE-REGISTERED ACCOUNTS

  1. In the event that an account is suspended for any reason, including but not limited to the failure to provide FIA related documents in a timely manner when requested, any player credits, promotional credits, vouchers, and winnings in that account will be forfeited.
  2. Accounts flagged for suspicious and/or fraudulent activities will be cancelled, and any play credits, promotional credits, vouchers, and winnings in that account will be forfeited.

12.  SECURITY POLICY

  1. Sunbet Namibia secures all player information, both online and offline. All data is transmitted using SSL encryption to ensure its protection.
  2. The player is solely responsible for the safekeeping of their login credentials, password, security details, account information, and withdrawal banking PINs. The player agrees to indemnify Sunbet Namibia against any claims, losses, or damages arising from the unauthorized use of their account and/or the provision of any information by the player. Unauthorized transactions on a player's account will not be canceled by Sunbet Namibia.
  3. Sunbet Namibia assumes no responsibility for accounts created using stolen or compromised personal information, including those resulting from identity theft. Sunbet Namibia shall not be held liable for any losses, damages, or unauthorized activity arising from such incidents. However, Sunbet Namibia shall ensure that it conducts virtual verifications.
  4. Sunbet Namibia understands the importance of information security and employs advanced techniques to safeguard data. We store all personal information received from players in an encrypted and password-protected cloud storage facility. Additionally, Sunbet Namibia ensures that its agents, affiliates, and suppliers also implement appropriate levels of information security.

13. DATA PROTECTION NOTICE (CONSENT AND ACKNOWLEDGEMENT)

I hereby expressly make the following acknowledgments in respect of Sunbet Namibia’s processing of my Personal information/ data, and/ or Special Information/ data (collectively referred to as “Personal Information/ data”):

  1. I confirm that I have read and understood the provisions of Sunbet Namibia’s Privacy Notice, available here, and fully appreciate the manner in which Sunbet Namibia may process my Personal Information/ data, as well as the purposes for which such Personal Information/ data may be processed.
  2. I acknowledge that Sunbet Namibia will be processing the Personal Information/data I provide from time to time.
  3. I understand that Sunbet Namibia may, depending on the circumstances, collect my Personal Information from sources other than myself.
  4. I acknowledge that Sunbet Namibia places a high premium on my privacy.
  5. I have read and understood the undertakings made by Sunbet Namibia in its Privacy Notice, to which this consent form relates, and I am aware that Sunbet Namibia will ensure that any and all of my Personal Information is processed with the reasonable standard of care expected from Sunbet Namibia.
  6. I fully appreciate that Sunbet Namibia will process my Personal Information only in a manner consistent with the provisions of its Privacy Notice and for the purpose(s) set forth therein.
  7. I confirm that I have been provided with adequate notification regarding the processing of my Personal Information by Sunbet Namibia, including the scope and purpose(s) for such processing, and my right to object to such processing should I choose to do so.
  8. I acknowledge that the processing of my Personal Information is a mandatory requirement for Sunbet Namibia to provide services to me.
  9. In light of the above acknowledgements, and insofar as it is required, I hereby give my specific and informed consent to Sunbet Namibia for the processing of my Personal Information/ data for any purpose(s) legitimately connected or related to Sunbet Namibia’s business operations, as outlined in Sunbet Namibia’s Privacy Notice, to which this consent form relates.

14. DELIVERY POLICY

  1. A confirmation message will be displayed on the website, and a bet slip will be generated once a bet has been successfully placed. Bets are considered accepted as soon as they are registered in our system, a transaction has been processed against the player’s betting account, and a bet slip has been generated, regardless of whether the player receives the confirmation message.
  2. All bets placed after the official start of an event will be void, unless the event is specifically labelled as available for in-play betting.
  3. The player is solely responsible for ensuring that bets are placed accurately. Once accepted by Sunbet Namibia, bets cannot be cancelled by the player.

15. INTELLECTUAL PROPERTY

  1. The player, or any other party, shall have no right to copy, in whole or in part, the Sunbet Namibia Product, software, or website, and shall not modify, adapt, translate, reverse engineer, decompile, disassemble, re-distribute, re-sell, or create derivative works based on the Sunbet Namibia Product.
  2. Nothing in this agreement shall serve to transfer either party's Intellectual Property rights to the other party.
  3. Sunbet Namibia shall retain all rights, title, and interest in the betting service, including all documentation, modifications, improvements, upgrades, derivative works, and all other Intellectual Property rights associated with the betting service, including Sunbet Namibia’s name, logos, and trademarks reproduced through the betting service.
  4. The player relinquishes all rights, title, and interest, including all intellectual property rights, in and to (a) the Player’s content; and (b) all data and reports provided to the player by Sunbet Namibia, prepared based on analysis of the Player’s content, subject to Sunbet Namibia’s underlying rights in the betting service.

16. DISPUTE RESOLUTION

Any dispute that a Player may have with Sunbet Namibia must follow the process outlined below:

  1. brief summary of the dispute, along with the player's contact details, must be sent to compliance@sunbet.com.na, Sunbet Namibia will then consider the dispute and respond within five (5) business days, unless a longer period is required, in which case Sunbet Namibia will communicate the extended timeline to the player.
  2. If Sunbet Namibia and the player are unable to resolve the dispute to the satisfaction of both parties within the stipulated timeframe, Sunbet Namibia will inform the player that the dispute should be referred to the Gambling Board of Namibia for resolution.
  3. In certain circumstances, Sunbet Namibia will refer the dispute to the Gambling Board of Namibia for independent evaluation.
  4. The player is not precluded from lodging a complaint directly with the Gambling Board of Namibia.
  5. The Gambling Board of Namibia shall conduct any investigation it deems necessary to resolve the dispute and shall issue a written notice to both Sunbet Namibia and the player, informing them of the determination and/or resolution.
  6. The determination and/or resolution of the Gambling Board shall become effective on the date the parties receive the written notice of such determination and/or resolution. The determination and/or resolution shall be considered final and binding on the parties, except that if either party is dissatisfied with the outcome of the Gambling Board of Namibia’s decision, and in that case only, the parties may approach a court of competent jurisdiction to determine the matter.

17. EXCLUSION

  1. Sunbet Namibia regards responsible gambling as a matter of paramount importance and is committed to upholding the highest standards in this regard. Players are strongly advised to gamble responsibly, and it is the sole responsibility of the Player to ensure they do so. Sunbet Namibia will not be held liable or responsible for any consequences arising from a player's failure to bet sensibly.
  2. The player may, at any time, request to be temporarily or permanently excluded from participating in betting, and consequently, from the use of the services.
  3. Any player who believes they may have a gambling problem is encouraged to complete the Problem Gambling Severity Index and/ or assessment here:

  6. The responsible gambling tools available include:
    1. Brief Break/ Cooling Off Period;
    2. Temporary account Suspension;
    3. Deposit limit;
    4. Semi-permanent Account Suspension; and
    5. Permanent Self-Exclusion.
  7. Sunbet Namibia shall not be held liable for any loss incurred by an excluded player who creates a new betting account under a different name and/or false pretenses and places bets before Sunbet Namibia becomes aware of the self-exclusion application.
  8. The responsibility to gamble responsibly rests solely with the player.
  9. Sunbet Namibia will not be held accountable in circumstances where the player fails to exercise restraint, regardless of any potential negligence on the part of Sunbet Namibia.

18. BREACH

Should the player breach any of these Terms and fail to remedy such breach within 48 hours after receiving written notice from Sunbet Namibia requiring the player to do so, Sunbet Namibia shall be entitled, without prejudice to institute any other rights it may have at law, to immediately terminate its contractual relationship with the player and to terminate or suspend any bet placed by the player, whether accepted or not, and/or to claim damages from the player. In such an event:

  1. All amounts owed by the Customer to Sunbet Namibia shall become immediately payable; and
  2. Sunbet Namibia shall have a lien and right of retention over all monies of the player on deposit with Sunbet Namibia, pending the settlement of any damages suffered by Sunbet Namibia.
